Terms of use

Effective . These terms cover the public website at rotmancare.com (the “Site”).

1. Agreement

By accessing or using the Site, you agree to these terms and to the privacy notice. If you do not agree, do not use the Site. These terms govern use of the Site. They do not set the terms of clinical care. Care, if it starts, is governed by the Practice’s intake documents.

2. Who owns and runs the Site

Owner and operator. The Site is owned and operated by Joelle Rotman, PMHNP (the “Practice,” “I,” or “me”). These terms are an agreement between you and the Practice only. The Practice alone is responsible for the Site, its content, the practice facts published on it, how it is used, its privacy notice, its compliance with law, and any clinical services the Practice agrees to provide.

Web vendor. Onitsoga Digital, the name used by Onitsoga Labs, Inc. (the “Vendor”), builds and maintains the Site as a vendor to the Practice, on the Practice’s instructions. The Vendor is not the owner or operator of the Site, is not a party to these terms, makes no promises to you, owes you no duty, and is not responsible for the Site’s content, for any decision of the Practice, or for anything that happens between you and the Practice. The Vendor is not your clinician and is not a crisis service.

You agree not to bring any claim about the Site against the Vendor or its owners, employees, or contractors, and to direct any claim about the Site to the Practice. The Vendor and its owners, employees, and contractors are intended third-party beneficiaries of every disclaimer, release, limitation, and indemnity in these terms and may enforce them.

“Site parties” means the Practice and the Vendor, together with their owners, members, employees, and contractors.

3. Information only

Text on the Site, including descriptions of services, approach, training, insurance, and resources, is general information about the Practice. It is not medical, psychiatric, or therapeutic advice for your situation. It is not a diagnosis. It is not a recommendation to start, stop, or change medication. It does not promise a result.

Insurance names and other practice facts can change. Confirm current participation, fees, and whether you are being accepted as a patient directly with the Practice before you rely on them.

4. No treatment relationship

Using the Site does not make you a patient. A treatment relationship with Joelle Rotman exists only if the Practice agrees to treat you and you have completed the intake steps the Practice requires.

A call, an email, or an Alma scheduling request is a request for contact. It is not, by itself, acceptance into the practice, a reserved appointment, or a duty to respond within a set time. The Site is not monitored around the clock.

5. Not for emergencies

The Site is not an emergency service and is not a way to reach a clinician in a crisis. If you are in immediate danger, call 911. If you are in a mental health crisis or thinking about harming yourself or someone else, call or text 988, or go to the nearest emergency room.

Do not use the Site, email, or voicemail for a crisis. The Site parties have no duty to monitor the Site for emergencies and are not liable for a failure to respond to one sent here.

6. Do not send health information here

The Site is not a secure channel for protected health information. Do not send symptoms, medications, diagnoses, records, or other clinical details through the Site, through ordinary email to an address listed here, or to the Vendor.

If you send that information anyway, you accept the risk that ordinary email, voicemail, and a public website are not confidential medical channels. The Site parties are not obligated to treat unsolicited messages as a medical record or to store them as one.

7. Scheduling and other services

New-patient scheduling opens on Alma, a separate company. Existing patients may use OnPatient, which this Site does not operate. Those services have their own terms and privacy policies. The Site parties do not control Alma’s or OnPatient’s availability, security, decisions, or fees.

Resource links are provided as a courtesy. Listing a clinic, book, podcast, or hotline is not an endorsement, a referral relationship, or a promise that the resource is still open, appropriate, or covered by insurance.

8. Acceptable use

You may use the Site for lawful personal information about the Practice. You may not:

  • try to break, probe, or overload the Site, or bypass a security control;
  • scrape, mirror, or republish the Site for another clinical website or directory;
  • use the Site to harass the Practice, the Vendor, or anyone else;
  • submit unlawful, infringing, or misleading material, or present yourself as the Practice or the Vendor;
  • use the Site in a way that violates these terms or applicable law.

9. Intellectual property

The wordmark, practice name, text, and photographs on the Site are used by the Practice for the Site. The Practice is responsible for having the right to publish them. You may not copy, frame, or reuse the Site, its text, its photographs, or its layout for another site without prior written permission.

You may link to a public page of the Site in a way that does not imply a partnership or endorsement.

10. The Vendor is not responsible to you

The Vendor provides a website service to the Practice, not to you. To the fullest extent permitted by law, the Vendor is not responsible to you for anything about the Site, including:

  • clinical care, prescribing, psychotherapy, intake decisions, or a failure to accept a patient;
  • the accuracy of practice facts supplied for publication, including insurance, fees, hours, and availability;
  • Alma, OnPatient, phone carriers, email providers, or any other third-party service;
  • health information you choose to send outside a secure patient channel;
  • loss arising from your reliance on general information on the Site;
  • the Site’s availability, security, errors, or compliance with any law, which are the Practice’s responsibility as owner and operator.

Nothing on the Site creates any relationship between you and the Vendor. Questions, complaints, and requests about the Site go to the Practice.

11. Disclaimer

The Site is provided “as is” and “as available.” The Site parties disclaim, to the fullest extent permitted by law, warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quiet enjoyment, and uninterrupted or error-free operation. They do not warrant that the Site is free of harmful code or that a host, link, or scheduling service will be available.

12. Limitation of liability

To the fullest extent permitted by law, the Site parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or the cost of substitute services, arising out of or related to the Site or these terms, whether in contract, tort, or otherwise, even if advised of the possibility.

The Vendor and its owners, employees, and contractors have no liability to you arising out of the Site or these terms. If a court decides that any such liability exists despite this, it will not exceed one hundred U.S. dollars (US $100) in total. Any responsibility to you for the Site rests with the Practice, as its owner and operator. The Practice’s liability for clinical care, if any, is outside these website terms and is governed by applicable law and the Practice’s own care agreements. These website terms do not limit liability that applicable law does not allow to be limited, including liability for gross negligence or willful misconduct where a limit is prohibited.

13. Indemnity

You will defend and indemnify the Site parties against claims, damages, losses, and reasonable attorneys’ fees arising out of your misuse of the Site, information you submit, or your violation of these terms or of someone else’s rights, except to the extent caused by the Site parties’ gross negligence or willful misconduct.

14. Governing law

These terms are governed by the laws of the State of New York, excluding conflict-of-law rules that would apply another state’s law. Courts located in the State of New York have exclusive jurisdiction over disputes about the Site or these terms, except that a Site party may seek injunctive relief in any court of competent jurisdiction to stop misuse of the Site. You consent to that jurisdiction and venue.

15. Other terms

If a provision is held unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver. These terms, together with the privacy notice, are the entire agreement between you and the Practice about use of the Site. They do not change a written treatment agreement you later sign with the Practice. The Practice may update these terms by posting a revised version and changing the effective date. Continuing to use the Site after that date means you accept the revision. The Practice may assign its interest in the Site. You may not assign these terms.
